Notice of intended prosecution by NW police for Speeding

    The following is just a bit of a Rant and a heads up for any small van drivers out there
    I got a notice of intended prosecution for speeding by North Wales Police, I was doing 58mph in a 60mph zone coming home from Blanau Ffestiniog and it came as a bit of a surprise for me to discover that Vans have to travel 10mph slower than cars because of the increased stopping distance so in their eyes I was 8mph over the limit.
    The only vans that can travel at the same speed as ordinary cars are Car derived vans or CDV's or basically a car with box stuck on the back, well my van is a Renault Kangoo and low and behold it says "car derived van on my V5C (which may be my saving grace) but the safety camera centre who sent out the intended prosecution letter say that there is NO model of car that my van is derived from unlike a corsa, Fiesta or vw polo etc so it is a Van n their eyes.(we will see)

    35 years of driving and at least 20 years driving vans of sorts and I never knew that. also my van has a maximum laden weight of less than 2 tons on the V5c so this too makes it exempt from the slower speed limit because my stopping distance is the same as a car, and less than some Chelsea Tractors.

    Rant over but small van drivers beware.

    Sounds like you might have some grounds to fight it, in which case I definitely would go down that route. Seems like a lot of bullshit either way though, and I'm not even a van driver.

    Happened to us last year, doing 69 on a duel carriageway. We even slowed down when we saw the mobile van. Apparently it's 60 in ours. They haven't gone out of their way to tell anyone have they. Twats.

    The spot were I was clocked was the A5 ty Nant, Dinmael stretch in Conwy, apparently a well documented spot for speeders one here doing 135mph http://cardealermagazine.co.uk/publish/motorist-caught-driving-136mph-60mph-zone/91623 and many others so I can fully understand that there needs to be deterrents but it also is probably a massive cash cow too. I rang the safety camera place to explain but I think the Liverpudlian twang had the guys wall up straight away, so I sent a copy of my V5c in that clearly states car derived van and a max laden weight of 1875KG, lets see what happens.
    I was just surprised and then a bit miffed with their response...Fuckers.

    If your documentation states that you are exempt, then you have nothing to worry about if you produce a copy of that to them. As with most speed camera related situations, I feel the police try their luck with anyone and hope that people will just settle with a fine instead of going through the stress and hassle of fighting it.

    It is all about the money.

    Cheers for replying John, the stupid bastard on the phone seemed to think that a Kangoo van has no car that it was derived from and in fact certain passenger cars have been derived from the Kangoo not the other way round, I am hoping that my V5C will pull rank over some phone operators decision, I will know inside 28 days time :)

    Yours must be a panel van Nick :(, It is these mobile fuckers who sit off on a bridge or somewhere else half hidden that get you.

    It will overrule him without a doubt as long as it is accurate, as these things can be registered wrong. I would contact the manufacturer and find out the specifics. Good luck!

    Trouble is, they will use the old "ignorance is no excuse to break the law", but these kinds of things suck ass. Another example was when I got a parking ticket in Digbeth, and I contested it as there was no time plate on that street. According to the law, a parking ticket is invalid without a time plate. The letter I got back was along the lines of "oh this is a specific parking zone so you will have driven past a sign several streets back so you should have known, cough up"

    Agreed... they are complete wankers!

    Its isnt well known that vans have a slower speed limit.
    A colleague of mine got caught doing 68 on a dual carriageway A road in a berlingo van which apparently is a 60 limit for vans.

    What is confusing though is that 'car derived vans' e.g. Astravans are exempt and can go normal speeds. Brighton has loads of Berlingo taxis, so are they van derived cars or are the vans car derived vans? The car version with 5 people in it can do 70 on a dual carriageway whereas an empty van ( which would be a whole lot lighter in reality) can only go 60!

    Doesnt really make sense....

    If the law spent as much time dealing with criminals as they do with ordinary road users the streets would be alot safer,
    its easy money for them.

    This has been going on for years I would chalenge it and go to court. speed limits here for type of vehicle https://www.gov.uk/speed-limits
    Even vosa are not sure as its not written in law exactly what a car derived van is. If you go to court and a judge/magistrate says your van is not a car derived van you have legal recourse againt the manufacturer who has described millions of vans as the same (misold to you and millions) think you may get some help if it came to this.
    The police just expect you to pay up and take the points.

    Myke, it seems that it is hit and miss and actually the luck of the draw if the main renault dealer register it when new as a panel van or a car derived van.
